An outstanding EB-1A RFE approval in the UI/UX design field. By restructuring the evidentiary framework and depth-mining key achievements, our team successfully cleared the Final Merits Determination within 3 days.

Key Issues & Challenges

Field: Graphic Design, with a focus on Digital Product and User Experience (UI/UX).

Although USCIS had already conceded in the RFE that the client satisfied at least three regulatory criteria, it requested additional evidence regarding the client’s "future work plan in the U.S. and prospective substantial benefit to the United States."

Based on our extensive experience, an RFE of this nature reflects the officer’s lingering doubts at Step Two of the "Two-Step Analysis"—the Final Merits Determination—regarding whether the client’s extraordinary ability truly rises to the top of the field. Because this phase involves a high degree of subjective judgment, simply answering the surface-level questions in the RFE Notice carries significant risk.

Our Legal Strategies:

  • Restructuring the Evidentiary Framework:

We conducted a comprehensive review of the initial submission to reshape the narrative surrounding the applicant’s original contributions, industry impact, and broader value, while systematically resolving weaknesses in the original filing.

  • In-Depth Evidence Mining:

Through multiple consultation rounds with the client, we uncovered and transformed previously underutilized projects, media features, and professional roles into key supporting evidence. We also conducted extensive legal research to integrate authoritative third-party sources—including leading industry media reports and official policy documents—substantially enhancing the overall credibility and persuasiveness of the petition.

  • Efficient Execution Under Tight Deadlines:

When retained, only three weeks remained before the RFE deadline. Our team completed the full response—comprising 550 pages of new supporting evidence and a detailed legal brief—one full week ahead of schedule.

Timeline

Aug 19, 2025: The client first contacted our firm for an evaluation after receiving an RFE notice. However, the client initially decided to proceed with their original counsel for the RFE response.

  • Oct 21, 2025: The client reached out to us again on an urgent basis, requesting that we take over and represent them in the RFE response.

  • Nov 05, 2025: The RFE response was submitted to USCIS.

  • Nov 08, 2025: The petition was officially approved.

The petition was approved in just three days after submission. This success once again demonstrates that in Final Merits RFEs, the key is not merely "supplying more documents," but rebuilding a persuasive framework that addresses the officer's subjective assessment with solid evidence and rigorous legal logic.
